Terms of Service

1. What Tindly is

Tindly is a paid, web-based tool that helps a store owner (“you”) keep track of utang (informal store credit) owed by your customers, and keep a simple list of what you sell, what it costs, and whether it is running low or out of stock. You access it through a browser, install it to your phone's home screen if you like, and sign in with an account tied to the email you registered with.

2. Buying a license

Tindly is sold as a one-time license for ₱199.00, not a subscription. A store owner who signs up through a referral link may pay less, as described in section 6. Paying gives you the right to use Tindly for as long as the service is offered, on any number of your own devices, tied to your account. Payment is processed by PayMongo; we do not store your card or e-wallet details ourselves.

Before you can pay, you must confirm your email address and verify a Philippine mobile number by SMS code. This is how we confirm the account is really yours and how we can reach you about your license.

Your license includes 50 text messages sent from Tindly's own number on your behalf, payment reminders and balance links alike. A short message counts as one text and a longer one as two; the app tells you the count before you send. Texts earned through referrals (section 6) are added to the same allowance. The allowance is per license, does not renew or expire, cannot be transferred to another account, and has no separate cash value. When it is used up, that way of sending stops; sending the same messages from your own phone is not limited by us and carries on as before.

3. Your account and your responsibilities

  • You are responsible for keeping your password and signed-in devices secure.
  • You are responsible for the accuracy of the customer names, numbers, and utang amounts you enter.
  • You must be the owner or an authorized operator of the store using the account.
  • Tindly is a record-keeping tool, not a collections agency or a lender. We do not chase your customers for payment on your behalf, and using Tindly does not make any utang legally enforceable that would not otherwise be.

4. You are the controller of your customers' data, and Tindly is the processor

This section matters, so we are explaining it plainly rather than in legal shorthand. When you add a customer's name, mobile number, and utang balance to Tindly, that person (your customer) never signs up for Tindly and never agrees to anything here. Under the Philippine Data Privacy Act of 2012, that makes you the personal information controller of your customers' data: you decide whose information goes in, what it is used for, and how long it is kept. Tindly acts only as your personal information processor: we store and process that data on your behalf, under your instructions, and only for the purpose of running the Tindly service for you.

This outsourcing arrangement means:

  • We will only use your customers' data to provide the Tindly service to you, never to market to your customers directly, and never to sell it to anyone else.
  • We apply reasonable organizational and technical security measures to protect that data while it is in our systems.
  • If you delete a customer or close your account, we will delete or anonymize the data we hold about that customer within the timeframe described in our Privacy Policy.
  • You remain responsible for having a lawful basis to collect and store your customers' information in the first place, for example that it is reasonable and expected in the ordinary course of running a small store extending credit to regulars.
  • If a customer asks you about the utang record you keep on them, or asks you to correct or delete it, you are the one who owes them that answer as the controller, and we will support you in acting on it, including through the data tools described in our Privacy Policy.
  • You may send a customer a balance link so they can see their own record. Anyone who holds that link and knows its PIN can see that customer's name, balance and recent entries, so it is your responsibility to send it only to that customer's own number and to nobody else. If you believe a link has been passed on, replace it from the customer's screen; the old one stops working at once. Tindly keeps a record of when each link was opened, which you can see, and does not share a customer's record with anyone who does not hold both the link and the PIN.

5. Refunds

See our Refund Policy for the refund window and how to request one. A refund returns what you actually paid for your license.

6. Referrals

Store owners with a paid license, and others we invite to take part, can invite other store owners to Tindly with their own referral link, found in the app under Settings. These rules apply to the person who shares the link (“the referrer”) and the store owner who signs up through it (“the new owner”).

  • What counts as a referral. A referral is made only when the new owner creates a new Tindly account in the same browser in which they opened the link, within 7 days of opening it. It cannot be added to an account afterwards, and each new owner can be referred only once.
  • The new owner's discount. A new owner who buys a license within 24 hours of creating their account pays ₱179 instead of ₱199 (10% off, rounded to the peso). A checkout opened within that time keeps the lower price until that checkout expires. After that, the full price applies. The discount has no cash value and cannot be combined with any other offer.
  • The referrer's reward. When the new owner has paid and 7 days have passed since their payment, the referrer receives 5 more texts and ₱20 in referral earnings. If the new owner has asked for a refund that is still being decided at that time, the reward waits until it is decided. If the new owner is refunded, or their license is ended, before the reward is released, the referral is cancelled and no reward is given.
  • Bonuses. Rewarded referrals also earn bonus texts: +10 SMS at 3, +20 at 5 and +50 at 10, then the same again in every 10 after that. Each bonus is given once.
  • No self-referrals. Referring yourself, another account of yours, or an account made only to collect a reward is not allowed. A referral that uses the referrer's own email address or mobile number gets no discount and no reward. We may review a referral made from the referrer's own browser, or with an email address that is a variation of the referrer's, before any reward is given.
  • Sharing your link fairly. Share your link with people you know or in ways they would expect. Do not send it as spam, present yourself as Tindly, or make claims about Tindly that are not true. If these rules are broken, we may cancel a referral, withhold or take back a reward given for it, or switch off a referral link. Where reasonably possible, we will tell you why.
  • Referral earnings and payouts. Once your available earnings reach ₱100, you can ask for a payout of the whole amount to a GCash, Maya or bank account, one request at a time. The account must be yours or a member of your family's, and you must give the account holder's name as it appears on the account. A payout sent to the account you gave counts as paid to you. We send payouts ourselves, within 2 business days of your request, and tell you by email when one is sent, with its reference. If we cannot send one, we tell you why and the amount returns to your available earnings. Earnings are not a deposit, do not earn interest, and cannot be transferred to another account.
  • Taxes. You are responsible for any tax that applies to what you earn through referrals.
  • You are not our agent. Sharing your link does not make you an employee, agent or representative of Tindly.
  • If your own license ends. Your link stops working for new sign-ups. Referrals made before then carry on under these rules.
  • Changes to the program. We may change the discount, the rewards, the minimum payout or these rules, or end the program, by updating this page. A change applies from the moment it is made, including to referrals not yet rewarded, though a new owner who has already signed up keeps the time they were given to buy. Rewards already given stay yours. If we end the program, you can still ask for a payout of all the earnings you have, whatever the amount, even below the minimum.

7. Service availability

We do our best to keep Tindly available and fast, but Tindly requires an internet connection to work and depends on services we do not control (like your mobile network and our hosting providers). We are not liable for outages caused by factors outside our reasonable control. Text messages and phone notifications are handed to the mobile networks and notification services that deliver them; we cannot promise that each one arrives, or arrives on time.

8. Ending your access

You may stop using Tindly at any time. We may suspend or end an account that is used to break these terms, break the law, or abuse the service (for example, attempting to access another store owner's data). Where reasonably possible, we will tell you why and give you a chance to respond first.

9. Changes to these terms

We may update these terms as Tindly grows or as the law changes. If we make a material change, we will post the updated date at the top of this page and, where practical, let you know by email.
